Article 1 – Definitions
In these terms and conditions:

Cooling-off period: the period in which the consumer can make use of their right of withdrawal;

Consumer: a natural person not acting in the course of a profession or business and who enters into a distance contract with the entrepreneur;
-
Day: calendar day;
-
Duration transaction: a distance contract concerning a series of products and/or services for which the delivery and/or obligation is spread over time;
-
Durable medium: any tool that enables the consumer or entrepreneur to store personal information in a way that allows future consultation and unchanged reproduction of that information;
-
Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period;

Model form: the withdrawal form provided by the entrepreneur that a consumer may fill in to exercise their right of withdrawal;

Entrepreneur: the natural or legal person offering products and/or services to consumers remotely;
-
Distance contract: a contract concluded using a system for remote sales organized by the entrepreneur, using only remote communication methods;

Remote communication techniques: methods that allow contracts to be concluded without the consumer and entrepreneur being physically present in the same place;
-
General Terms and Conditions: the current terms and conditions of the entrepreneur.

Article 3 – Applicability
These general terms apply to every offer from the entrepreneur and every concluded distance contract between the entrepreneur and the consumer.
Before the distance contract is concluded, the consumer is provided with these terms. If that is not reasonably possible, the consumer will be informed where the terms can be viewed and that they will be sent upon request free of charge.
In the case of electronic transactions, the terms can be shared in a way that they can be stored on a durable medium.
If specific product or service conditions also apply, the consumer may always invoke the provision most favorable to them in case of contradictions.
Article 4 – The Offer

Offers with limited validity or under conditions will be clearly stated.

Offers are non-binding. The entrepreneur may adjust or withdraw them.

Product descriptions are accurate and detailed, with images that reflect the products truthfully. Obvious mistakes do not bind the entrepreneur.

The offer clearly outlines the rights and obligations involved in acceptance, including price, taxes, shipping, payment methods, withdrawal rights, and contract duration.
Article 5 – The Agreement

The agreement is formed once the consumer accepts the offer and meets its conditions.

If the consumer accepts electronically, the entrepreneur confirms receipt without delay.

For electronic transactions, the entrepreneur ensures secure data transfer and payment.

The entrepreneur may verify the consumer’s ability to meet obligations. If justified, the entrepreneur may refuse or condition an order.

Upon delivery, the entrepreneur provides necessary information such as the right of withdrawal, service guarantees, and cancellation policies.
Article 6 – Right of Withdrawal
For Products:

Consumers may withdraw within 14 days after receiving the product.
-
The product must be returned unused and in original condition, unless necessary for inspection.

Notice of withdrawal must be made within 14 days of receipt, and returns must be sent within 14 days after notification.
For Services:
-
Consumers can withdraw within 14 days from the agreement’s start.

Instructions on exercising this right are provided with the offer or delivery.
Article 7 – Costs in Case of Withdrawal

Consumers bear return shipping costs.

Refunds are issued within 14 days of withdrawal, once the product is returned or proof of return is provided.

Consumers are liable for any reduction in value due to mishandling.

If legally required withdrawal information was not provided, no liability applies.
Article 8 – Exclusion of Withdrawal Right
Withdrawal may be excluded for:

Custom or personalized products

Perishable goods
-
Hygiene products with broken seals
-
Software/media with broken seals
-
Services performed before the cooling-off period ends with consent

Specific bookings or leisure activities tied to dates
Clear notice must be given before concluding the agreement.
Article 9 – The Price

Prices are valid during the offer period and include VAT.

Price increases within 3 months of the agreement are not allowed unless legally mandated.

Errors in pricing do not bind the entrepreneur.
Article 10 – Conformity and Warranty

Products and services must match the agreement, specifications, and legal standards.

Warranty supplements legal consumer rights.
-
Consumers must report defects within 2 months of discovery.

Warranty is void if:
-
Products are altered or repaired by the consumer or third parties
-
Products are mishandled
-
Damage is caused by government regulations or usage beyond normal wear
-
Article 11 – Delivery and Execution
-
Orders are handled with care and delivered to the address given by the consumer.

Delivery takes place within 30 days unless otherwise agreed.
-
If not possible, consumers are informed and may cancel without cost.

Substitute items may be offered but must be clearly identified.
-
The entrepreneur bears the risk until delivery.
Article 12 – Duration Transactions: Termination and Renewal
Termination:
-
Consumers may terminate indefinite or fixed-term contracts with a notice period of up to one month.
-
Termination must be as easy as signing up.
Renewal:
-
Fixed-term contracts cannot be automatically renewed beyond the agreed term.

Exceptions apply to periodicals under specific conditions.
Duration:
-
Contracts lasting more than one year may be terminated after one year with a notice period of one month.
Article 13 – Payment

Unless otherwise agreed, payments must be made within 7 days after the start of the cooling-off period.

The consumer must report any incorrect payment information immediately.
-
In case of non-payment, reasonable collection costs may be charged.
Article 14 – Complaints Procedure

Complaints must be submitted clearly within 2 months after discovery.

Complaints are answered within 14 days.
-
If resolution takes longer, the consumer receives a timeline.
-
If unresolved, disputes can be submitted to WebwinkelKeur or its appointed arbitration committee.
-
A complaint does not suspend obligations unless agreed in writing.
Article 15 – Disputes

Dutch law exclusively applies to these terms and the related contracts.

The Vienna Sales Convention does not apply.
Article 16 – Additional or Deviating Provisions
Any additional or deviating provisions must not be to the consumer’s disadvantage and must be recorded in writing or on a durable medium.
